Understanding Atlanta’s Temporary Eviction Moratorium: What Landlords Need to Know

What’s Happening

In response to the ongoing federal funding lapse and the potential cutoff of critical benefits such as the Supplemental Nutrition Assistance Program (SNAP), Atlanta Mayor Andre Dickens has issued an administrative order temporarily halting certain eviction and penalty actions within the City of Atlanta.

This action is intended to protect vulnerable residents in city-supported housing programs who may experience delayed or suspended federal assistance payments during this period.



Key Details of the Order

The Mayor’s administrative order includes the following provisions:

  • Eviction Suspension:

    All eviction filings for non-payment of rent are temporarily suspended through January 31, 2026, or until the federal funding lapse is resolved.

    This moratorium applies only to housing that is city-owned, city-sponsored, or city-funded, including properties managed by:

    • Atlanta Housing Authority (AHA)

    • Invest Atlanta

    • Partners for HOME

    • and other City of Atlanta–supported programs.

  • Utility Protection:

    The Department of Watershed Management has been directed not to terminate water service for residential customers participating in these programs during the same period.

  • Waiver of Late Fees and Penalties:

    Landlords managing affected properties are prohibited from charging late fees or penalties related to rent non-payment while the moratorium remains in effect.


Who This Affects

It’s important to note that this order only applies to properties within the City of Atlanta and those directly connected to city funding or assistance programs.

If your property is located outside the city limits or is privately owned and not funded by city housing programs, this moratorium does not apply to your property.

Landlords with properties in Fulton County, Clayton County, DeKalb County, or surrounding areas that are not inside the City of Atlanta are not impacted by this order.


What Landlords Should Do

  1. Verify Property Location:

    Confirm whether your property is physically located within the City of Atlanta limits or under a city housing program (such as Atlanta Housing).

  2. Monitor Tenant Payments:

    If your tenant receives assistance from Atlanta Housing (AHA) or another city-funded source, be aware that rent payments may be delayed due to the federal funding lapse.

  3. Stay Informed:

    #1Source Property Management is monitoring updates from Atlanta Housing, the City of Atlanta, and the Atlanta Apartment Association. We will notify all affected owners of any changes or extensions to the moratorium.

  4. Continue Standard Procedures (if not affected):

    For properties outside the City of Atlanta or unrelated to city programs, standard Georgia landlord-tenant laws remain in effect, and eviction filings may continue as usual when applicable.
